Terms of Service

1. Acceptance

By using KreatoArt ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. The Service

KreatoArt provides artists with tools to manage commissions, showcase portfolios, and communicate with clients and fans. We offer free and premium plans.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account.
• You must be at least 16 years old to use the Service.
• One person may not maintain more than one account.

4. Artist content

You retain all rights to content you upload to KreatoArt (portfolio images, profile information, etc.). By uploading content, you grant us a limited license to display, store, and distribute it as part of the Service.

You agree not to upload content that:

• Infringes on intellectual property rights of others.
• Contains illegal, harmful, or abusive material.
• Violates any applicable law or regulation.

5. Commission agreements

KreatoArt facilitates communication between artists and clients but is not a party to any commission agreement. The contract for a commission is between the artist and the client. We are not responsible for the quality, delivery, or payment of commissions.

6. Fan subscriptions

Fans subscribe to artists voluntarily. Artists may not abuse fan email addresses or send spam. We reserve the right to limit or disable notification features for artists who violate this rule.

7. Pricing and payments

• Free plan: includes up to 3 commission slots with KreatoArt branding.
• Premium plan: priced at 1€ per slot per month. You choose how many slots you need.
• Early Access: selected users receive premium features for free during the early access period.

We reserve the right to change pricing with 30 days notice. Existing subscriptions will be honored until their renewal date.

8. Prohibited use

You may not:

• Use the Service for any illegal purpose.
• Attempt to gain unauthorized access to our systems.
• Scrape, crawl, or extract data from the Service without permission.
• Use the Service to send unsolicited messages or spam.
• Impersonate another person or artist.
• Interfere with or disrupt the Service.

9. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these terms. Upon termination, your public profile will be removed and your data will be deleted within 30 days.

10. Disclaimer

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.

11. Limitation of liability

Our total liability to you for any claims arising from the Service is limited to the amount you paid us in the 12 months preceding the claim, or 100€, whichever is greater.

12. Governing law

These terms are governed by the laws of Spain. Any disputes will be resolved in the courts of Madrid, Spain.

13. Changes

We may update these terms from time to time. We will notify registered users of significant changes via email. Continued use of the Service after changes constitutes acceptance.
